FLSA Update:
U.S. District Judge Issues an Injunction to Bar the FLSA Overtime Rule Change
On Tuesday, November 22, 2016 a Federal judge in Texas issued an injunction to bar President Obama’s revisions to the Fair Labor Standards Act (FLSA). The revisions were expected to go into effect on December 1st and would have essentially doubled the exemption threshold for overtime pay from $23,660 to $47, 476 and impacted over 4 million workers.
While FLSA will not take effect on December 1 as planned, it still could be implemented later down the road. SHRM is encouraging employers to put a hold on reclassifying employees until more information on the future of the ruling is determined.
